Standard Terms and Conditions for Wedding Photography
The Client shall
Pay the full amount prior to delivery of photos and albums. This includes a 50% deposit to block the photographer’s dates and remaining amount after completion of all events.
Make every effort to inform photographer of change in schedule and timing of events.
The Photographer shall
Capture candid or posed images during the above mentioned events.
Make reasonable efforts to capture requested images, but is unable to promise/guarantee specific photographs
Not be responsible for conventional staged photographs
Not be responsible for images compromised due to circumstances beyond the Photographer’s control such as other photo/videographers’ lights, lateness of the individuals to be photographed, weather conditions, schedule complications or venue restrictions
Own the copyright in all images created and have the exclusive right to make reproductions in any manner
Retain the irrevocable right to use the photographs in all forms and in all media without any restriction for any lawful purposes.
If the Photographer is unable to provide these services due to Acts of God, illness or other cause beyond the control of both parties, the retainer deposit will be returned to the Client but the Photographer will have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that the photographic materials are lost or damaged during transit or processing without fault on the part of the Photographer.
Copyright & Usage
Without getting too legal & technical, I want to further explain the clause in my standard agreement.
Copyright for wedding photographs is not something that has been traditionally discussed in India.
Who owns the rights to the images?
In a sense, both the client and the photographer. In your standard package, what you are paying for is something called fair use rights. This means, you are free to do whatever you want to do with your photos except use them for any commercial activity, i.e. use them to make money. In the standard agreement, I state that I own the copyright for the photographs taken. This means I can use the photographs on my website, blog, social media platforms as well as any other media. This remains the case, unless, the client, specifically wants to purchase those rights. If you wish to do so, you can let me know in advance and I will include that in your package.
I do not want my photos anywhere.
I do respect your need for privacy. All I can say for that is that I use the photos mostly for my blog or my facebook page and it's mostly, so that people can see my work/portfolio. In this industry, my photos are basically my CV =) If it is something that you and your fiancé are not in favour of, I can definitely amend the agreement.
